Legal Affairs

It is the division that supervises all legal actions and cases and prepares investigative and audit committees, guarantees and agencies of all kinds, and also pleads lawsuits related to the college before the competent courts. The division is divided into two units: –

  • Legal Consultation Unit
  • Rights and Claims Unit

Second: Duties of the Director of the Legal Division:

1- Expressing opinion and advice on legal matters.

2- Preparing a study of the various draft laws of the university and the Ministry of Higher Education and Scientific Research and expressing an opinion on them.

3- Auditing contracts related to the college, expressing an opinion on the contracts presented to the department by the college, and approving contracts of all types.

4- Representing the college before the competent courts and judicial authorities.

5- Follow up on the mechanism for distributing and allocating lands and housing units to members of the college affiliated with the Ministry, and then approach the university/legal affairs department.

6- Contributing to committees that require legal membership such as the general inventory of the college – inventory of war damages – promotion and bonus – determining salary – Accountability and Justice Committee – Committee for Political Dismissals – Dismissal Committee – Student Discipline Committee – Bidding Committees – Contributing to the numbers of committees that are referred to the Division Legal investigation and auditing and then implementing the committee’s recommendations.

7- Any other work assigned by the Division.

Third: Duties of employees working in the Legal Division.

1- Organizing the division’s incoming and outgoing work.

2- Editing correspondence related to the work of the college and answering inquiries from the university and other relevant formations.

3- Organizing guarantees, agencies, and pledges related to the work of the division.

4- Save and archive the division’s mail.

5- Prepare all necessary documents with official mail.

6- Guarantees and pledges related to the college, as shown below:

A- Guarantees referred to the Legal Division (guarantees for primary and postgraduate students (employee and non-employee), guarantees for associates enjoying academic leave within the Republic of Iraq, loan guarantees for teachers and employees) and all types of guarantees.

B- Employee pledges (maternity leave, five-year leave, long leaves, marital pledge leave)

C- Pledges for students (postgraduate studies, initial studies)

D- Pledges regarding accountability and justice.

7- Special agencies for receiving salaries for college members.

8-Issuing a clearance certificate for college members (transfer, placement, long leave)

Fourth: The units that make up the Legal Division.

The Legal Division consists of the following units:-

1- Rights and Claims Unit. The employee in this unit represents the college before the competent courts.

2- Legal Consultation Unit. The employee in this unit expresses the opinion requested from him by the college’s departments and divisions and answers oral and written legal inquiries.

The work and tasks assigned to the Legal Division

1- Representing the college in the competent courts in every right it has or has against it, attending police stations in every matter that requires it, and filing civil and criminal lawsuits, especially against counterfeit students, which amounted to 13 thirteen lawsuits.

2- Representing the college before the Integrity Commission in all its branches for the purpose of recording statements against the forgery students who claim to be graduates of our college.

3- Scrutinizing contracts referred to the Legal Division, expressing an opinion regarding them, and then approving them.

4- Follow up on matters related to politically dismissed persons, inform them of the decisions of the Politically Dismissed Committee in the Ministry and the Verification Committee in the Council of Ministers, and respond to the letters received against them.

5- Conducting notifications received against members of the college, whether they are from the courts, enforcement departments, or other state departments.

6- Participating in the work of the committees, preparing minutes, and keeping their priorities. These committees include:

  • All investigative committees
  • Audit committees
  • Technical committees
  • Student Discipline Committee
  • Student Transfer Committee
  • Salary scale committee
  • Committee for opening and analyzing offers for tenders submitted to the college
  • A committee to determine and estimate the damage caused to the college as a result of the college’s roof restoration contractor
  • College Stores Inventory Committee
  • Bidding Committee for College Sites
  • Committee for selling and renting state funds
  • Promotions Committee

It provides legal advice to all college formations whenever requested, stating the legal opinion on the matters presented to it, and providing them with the instructions and laws they request to support the legal opinion.

Editing and printing official letters related to legal work and all of the above matters, and memorizing the instructions and laws issued in the Iraqi Gazette.
